Is it legal for a real estate agent to list a house for sale when its not to try to generate leads?

I purchase my home in April ‘07 and noticed today that the agent the seller used has posted it for sale on their website and yahoo! real estate effective Feb 10, ‘08. My house is not for sale. I haven’t even considered selling the house and have not had contact with that agent since the sale last year. What is my recourse? Any?

Yes, you have recourse. First, call the realtor and demand that the house be removed. Then, if it’s a big agency or national chain, call the home office and find out who is the manager and send a written complaint. Include printout of the website that show the house listed. Oh, when you call the realtor with the bogus listing, mention that you are calling the DA’s office if your house is still listed in 24 hours.
